Arbitration & ADR

?Cases are won more by perspiration than by inspiration. There is no substitute for plain old fashioned hard work. Regardless of the case or the cause, we must do nothing less than our best.? This simple, heartfelt quote by Shook, Hardy & Bacon L.L.P. (SHB) co-founder David R. Hardy is the cornerstone of the international law firm. It set the tone for a firm that draws on more than a century of experience to be the leading Arbitration & ADR firm in the industry.

Known for our aggressive and creative litigation strategies, SHB?s Arbitration & ADR practice is highly skilled in arbitration, mediation and alternative dispute resolution.

We draw on a rich tradition of trial advocacy, and our Arbitration & ADR practice is well-positioned to meet the needs of litigants interested in dispute resolution. Our skilled mediators and arbitrators bring years of litigation experience to the dispute resolution table. Our Arbitration & ADR attorneys have served in court-mandated mediation, as well as in situations where parties have sought to mediate without court compulsion. We have also acted as arbitrators under various promulgated and ad hoc rules, such as the rules of the American Arbitration Association, the CPR Institute for Dispute Resolution, the National Association of Securities Dealers, Inc., and the New York Stock Exchange. A founding member of the CPR Institute for Dispute Resolution, the firm has long supported the institute?s aim of finding cost-effective ways to settle disputes.

In addition, SHB has been involved with innovative ADR processes. For example, an SHB lawyer serving as the ?neutral? under a case management order also conducted all discovery in the matter, assuming a role similar to that of a court-appointed investigator in some European courts. Under this arrangement, the neutral received ?position papers? from the parties and prepared a report used as the basis for settlement. Another such process involves pre-suit ADR, whereby the neutral will supervise the exchange of documents, the witness interviews and the expert presentation to the litigants, prior to engaging in traditional mediation.

We realize the time and expense of a trial are not always the answer. We work closely with our clients to meet their needs, while also considering the financial ramifications of all the options. To learn more about our Arbitration & ADR practice, contact us today.
