Creditor Rights
The international law firm of Shook, Hardy & Bacon L.L.P. (SHB) provides expertise in a wide variety of bankruptcy and creditor rights issues for secured creditors, unsecured creditors, debtors, lessors, lessees and investors.
The SHB
Bankruptcy & Creditors' Rights Practice is experienced in negotiating, litigating and enforcing all types of claims in bankruptcy and creditor rights. We offer our clients assistance with debtor financing and other financial issues; corporate reorganizations; and selling and purchasing property out of bankruptcy estates. In addition, we ensure our clients understand their creditor rights in regard to bankruptcy litigation involving preferences, fraudulent conveyances, post-petition transfers, setoffs, and lien priority disputes.
Credit issues do not always result in bankruptcy filing. We recognize that insolvency often leads, instead, to a restructuring of the debtor-creditor relationship. Conversant in all facets of bankruptcy counseling, we provide guidance on these types of workouts and various other alternatives, including assignments for the benefit of creditors, receiverships, repossessions, and foreclosures, that aim to restructure the relationship or enforce the obligation.
With offices in nine locations in the United States and Europe, we are able to work on bankruptcy and creditor rights issues with clients around the world. This experience includes the pursuit of creditor rights outside bankruptcy by obtaining U.S. judgments against debtors and enforcing foreign judgments in the United States. In executing such actions, we have worked closely with private investigative firms specializing in the location of hidden assets. We draw on the extensive litigation background of our bankruptcy lawyers who have also written published treatises on the recognition and enforcement of foreign arbitral awards, to successfully represent our clients.
Bankruptcy laws, and the resulting creditor rights, are fluid, making it critical to work with a firm that stays abreast of new laws and important legal decisions. At SHB, we are committed to helping you understand your creditor rights. Contact us today for more information.
