A Brief Update on the EEO-1 Requirements

The U.S. Equal Employment Opportunity Commission (EEOC) regularly collects data from employers in the EEO-1 Report. Employers that meet the reporting threshold have a legal obligation to provide the data. The data is used by the EEOC for a variety of purposes, including enforcement, self-assessment by employers and general research. The information is typically shared with other authorized federal agencies in an effort to avoid duplication of the collection of data. Although the data itself is considered confidential, aggregated data is available to the public. The 2021 EEO-1 Component 1 data collection is tentatively scheduled to open on April 12, 2022, and the tentative deadline to file the 2021 EEO-1 Component 1 report is currently set for May 17, 2022. Updates regarding the 2021 EEO-1 Component 1 data collection will be posted to www.EEOCdata.org/eeo1 as they become available. In light of the upcoming tentatively scheduled deadline, this brief summary on EEO-1 requirements may be helpful.

  • The EEO-1 Component 1 report is a mandatory annual data collection that requires all private sector employers with 100 or more employees, and federal contractors with 50 or more employees meeting certain criteria, to submit demographic workforce data, including data by race/ethnicity, sex and job categories. The filing by eligible employers of the EEO-1 Component 1 Report is required under section 709(c) of Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. § 2000e-8(c), and 29 CFR 1602.7-.14 and 41 CFR 60-1.7(a).
  • The 2021 EEO-1 Component 1 data collection is tentatively scheduled to open on Tuesday, April 12th, 2022. The tentative deadline to file the 2021 EEO-1 Component 1 Report is Tuesday, May 17th, 2022. Updates regarding the 2021 EEO-1 Component 1 data collection will be posted to www.EEOCdata.org/eeo1 as they become available.
  • Companies must file the 2021 EEO-1 Component 1 Report if they were in business and meet the filing requirements for that year.
  • Companies determined to be ineligible for 2021 must certify their ineligibility in the EEO-1 Component 1 Online Filing System to remain in compliance.
  • Companies that have organizational changes that occurred since their last filing due to acquisitions, mergers and/or spinoffs are required to report this change in the EEO-1 Component 1 Online Filing System before proceeding with filing.
  • Save a PDF copy of your company's EEO-1 Component 1 Report as soon as the Report has been submitted and certified.
  • What you need to file:
    • Company ID and unique PIN (provided via U.S. postal mail and email for 2019/2020 filers or at registration for new filers)
    • Company EIN and NAICS code
    • Company DUNS Number (if a federal contractor)
    • Establishment address, EIN and NAICS code, for each establishment
    • Establishment DUNS number (if a federal contractor)
    • Count of all full- and part-time employees during the specified workforce snapshot pay period selected by the employer
    • Sex and race/ethnicity of all employees
    • Job categories of all employees
