Litigation Discovery

Litigation Discovery

For more than 30 years, Shook, Hardy & Bacon, L.L.P. (SHB) has successfully led complex litigation in state, federal and international arenas. We have represented numerous Fortune 500 companies affected by legal actions targeting entire industries. Because complex litigation matters often involve enormous amounts of documents and litigation discovery, our case management teams are staffed by attorneys who are experts in e-discovery, privilege law, and document preservation and production requirements. Careful planning and diligence allows us to achieve an ongoing goal of minimizing the risks and burdens of litigation discovery for each case.

Prior to litigation, discovery is handled by the SHB Class Actions & Complex Litigation Practice. As a large, global firm, our intricate technical infrastructure enables us to support clients with large-scale data and document management needs, which is why we work closely with our eDiscovery, Data & Document Management team on litigation discovery.

A leader in the litigation support field for more than 25 years, we are credited with many of the data management strategies that have become industry standards. We have partnered with many Fortune 50, 100 and 500 clients to develop proactive, efficient solutions for complex litigation, discovery and electronic document retention. This practice offers a unique blend of legal, technical and strategic acumen developed over decades handling large and extremely contentious mass tort litigations.

Through leadership roles with several professional associations, we have been instrumental in shaping legal developments in this emerging area of the law. Our attorneys contribute to prominent legal publications and present at national and international symposia. We have twice sponsored the National Forum on E-Discovery and Electronic Records Management in conjunction with the University of Kansas School of Law. An SHB partner recently co-authored an article in BNA's Digital Discovery and E-Evidence Report. Titled "You Can't Always Get What You Want . . . But If You Focus on the Case and Follow the Rules, You Can Get What You Need," the article discusses the mechanisms implicit in the Federal Rules of Civil Procedure that can be used to "keep overbroad discovery requests in check."
