Wajert Provides Commentary for Law360 on Expanded 9/11 Victims’ Compensation Fund Coverage

SHB Partner Sean Wajert has commented on a proposed rule that would allow first responders and certain other victims with many types of cancer to be compensated for their health-care costs from the Sept. 11 Victims’ Compensation Fund in a Law360 article appearing on June 11, 2012. If coverage is expanded to benefit these individuals, critics contend that the fund could run out of money or its extension beyond the current 2016 expiration date could be jeopardized. Wajert noted that federal officials have admitted the evidence is not sufficient to definitively link exposure to dust from the World Trade Center collapse to cancer. He also observed, with respect to the potential for those without cancer to resent use of the fund for more speculative claims, “Any time you have a limited fund, you have at least the potential for conflicts.” To read the article, please click here.
