Barkett to Speak During National Institute on Credit Crisis Litigation

SHB Partner John Barkett will serve on a panel during the American Bar Association’s “National Institute on Credit Crisis Litigation” on October 23, 2009, in New York City. Titled “Goliath vs. Goliath: When Businesses Square Off in Credit Crisis Litigation,” Barkett will discuss his paper, "Material Breach: Rescission Versus Excused Performance Under New York Law," a comprehensive analysis of the New York common law on the subject of avoiding contractual obligations which is a frequent theme in financial-crisis litigation. Barkett will also discuss "MAE," or Material Adverse Effect clauses, which provide an escape mechanism for an obligor if they can be satisfied. To view the conference brochure, please click here.
