The Louisiana Record Features Silverman and Schwartz’s Federal Preemption Article

SHB Of Counsel Cary Silverman commented on federal preemption in a June 11, 2010, article in The Louisiana Record titled “Legal observers decry proposal to overhaul federal preemption.” The article highlights a Tulane Law Review article co-authored by Silverman and SHB Partner Victor Schwartz titled "Preemption of State Common Law by Federal Agency Action: Striking the Appropriate Balance that Protects Public Safety."
According to Silverman, elimination of preemption may make cases more likely to proceed to trial, “[b]ut at the end of the day, if that case goes before a jury, that jury can still consider a company's compliance following federal regulations and whether or not they should be held liable."
