San Francisco Office Obtains Second Dismissal of Federal Environmental Case

U.S. District Court Judge Jeremy Fogel has dismissed the first amended complaint in Chubb Custom Insurance Co. v. Space Systems/Loral, Inc., et al., No. C 09-04485 JF (PVT) (N.D. Cal. June 23, 2010) (Chubb II), addressing in part the rights of insurance companies to seek subrogation of environmental claims under CERCLA section 112(c). This is the second time in four months that Judge Fogel has granted motions to dismiss plaintiff’s complaint under FRCP Rule 12(b)(6) and the federal pleading standards articulated by the U.S. Supreme Court in Twombly and Iqbal.
