Bill has tried more than 80 jury cases in federal, state and military courts and tribunals and has been active nationally and internationally in the defense of civil litigation. He has taught more than 100 programs on trial practice, litigation strategy and legal writing.

Representative Matters

Nationwide Class Action Dismissed: Led a team that won dismissal of a purported nationwide class action against Nissan North America Inc. Filed by 18 named plaintiffs from nearly as many states, the lawsuit claimed Nissan concealed that the floorboards in certain vehicles were more prone to rust than normal. Judge John Robert Blakey, U.S. District Court, Northern District of Illinois, ruled the Court did not have jurisdiction over the out-of-state plaintiffs, then dismissed all of the allegations of the Illinois Plaintiff for failing to state a claim for relief. DeMaria v. Nissan North America Inc.

Federal Action Locates Missing Western - States Oil Rights: Brought federal fraud action for out-of-state purchaser of multi-thousand-acre family ranch. The tract chart in the auction brochure said the mineral rights were included, and the final bid price reflected that. But the fine print in the sales agreement tried to turn the auction into an “as-is” event, consistent with the minerals having been conveyed away years earlier. Withstood Defendants’ Motion to Dismiss. Then executed staged document and deposition discovery of the many family members, saving for last the siblings who had actually planned the sale. All of that followed extensive, in-person interviews of the out-of-state auction company. Case settled on the eve of the last Defendant depositions.

Aggressive Third-Party Discovery Brings Early Settlement to International Dispute: Bill defended a foreign corporation and others in a federal action brought by a finance affiliate of Textron. Filed May 30, 2012, defendants’ third-party action shifted the focus of the action from nonpayment of a commercial lease to a product defect claim against the manufacturer, another Textron company. A week later, defendants obtained an innovative discovery ruling that permitted immediate, broad-ranging document discovery from the manufacturer, stayed other discovery and ordered all parties to early mediation. Only three months later, the action settled.

Judicial Panel on Multidistrict Litigation - Successfully opposed centralization of nationwide domestic drywall cases before JPML. Argued case to panel.

Federal Court Jury Verdict for Actual Damages, Punitive Damages, and Attorneys' Fees - Lead counsel for The Paradigm Alliance, a Wichita, Kansas-based pipeline public awareness company. Filed and prosecuted a multi-count action for violation of the Computer Fraud and Abuse Act, misappropriation of trade secrets, fraud, breach of fiduciary duty, and breach of contract. Following a two-week trial in Wichita, Kansas, court granted Paradigm's motion for judgment as a matter of law on defendants' counterclaim. The next week, the jury awarded Paradigm the prayer of the Complaint, found defendants' conduct intentional and malicious on the trade secrets count, and awarded punitive damages. The jury's findings enabled Paradigm to apply for its fees and litigation expenses, which the Court awarded.

Breach of Contract - Lead counsel for defendant Miller Brewing Company in $500 million federal court action for breach of license agreement to brew beer in India. Canadian plaintiff, represented by Chicago and Wisconsin firms, filed in federal court in Milwaukee. Miller defeated plaintiff's jury demand and conducted fact and expert discovery throughout the United States and in India. Court granted Miller's summary judgment motion and dismissed all of plaintiff's claims. Argued case to Seventh Circuit Court of Appeals, which affirmed.

Consumer Class Action - Lead counsel for retailer in Madison County, Illinois, national class action involving more than 60 defendants. While case was still in pleadings phase, relied upon state court procedure and moved to dismiss for dilatory service of process. Motion was denied after lengthy hearing. Utilizing evidence surprisingly adduced by plaintiffs during that hearing, immediately moved for reconsideration, argued that motion on behalf of all affected defendants, and succeeded in getting action dismissed.
