Fiona’s practice focuses on intellectual property litigation with an emphasis on complex patent litigation. She has represented both plaintiffs and defendants in complex multipatent lawsuits and has worked on all aspects of patent litigation, from the development of initial case strategies through trial and appeal. Fiona uses her degree in electrical engineering to understand the intricacies of her clients’ products, which often involve computer software, computer hardware and telecommunication technologies.

Fiona’s work has frequently resulted in favorable settlements prior to trial and jury trials resulting in successful verdicts. Representative patent infringement cases involving jury trials include technologies involving:

  • VoIP technology, resulting in a finding of willful infringement and a jury award of $139.8 million against Time Warner Cable, the largest-ever patent verdict in the State of Kansas (Sprint v. Time Warner Cable, D. Kan.);
  • electronic medical record technology, resulting in a jury verdict of non-infringement and invalidity on all asserted claims (RLIS v. Cerner, S.D. Tex.); and
  • telecommunications hardware, resulting in a $23 million jury verdict against Samsung, along with favorable settlements from other defendants resulting in licensing fees approaching $70 million (Fractus  v. Samsung Electronics, E.D. Tex.).

In addition to her litigation experience, Fiona has advised clients on patent licensing and sales and provided freedom-to-operate, non-infringement and invalidity opinions. She has also handled multiple inter partes reexaminations as well as an inter partes review.

Before joining the legal profession, Fiona worked as a dancer and choreographer, performing with the Houston Metropolitan Dance Company, Robert Moses's KIN and Psophonia Dance Company.
