David focuses his practice on intellectual property litigation, including copyright, trademark and patent matters. He has worked on all aspects of litigation, from claim response, discovery and pretrial motions through trial. Before attending law school, David worked as a paralegal defending Fortune 500 companies in product liability litigation.

David’s work includes defending Rimini Street against copyright infringement, computer access and business tort claims related to third-party maintenance of enterprise software. He helped manage fact and expert discovery, prepare witnesses, draft motions and develop trial strategy. David also focused on pursuing a declaratory judgment of non-infringement on behalf of Rimini Street.

David has litigated patents and conducted trademark infringement investigations for clients. Through his investigations, David is often able to resolve incidents of potential infringement without litigation.

David has managed prosecution of foreign patent applications across Asia and Europe, including coordinating with foreign outside counsel regarding responses to office actions and prosecution of domestic patent counterparts.

In addition to his intellectual property work, David has counseled clients on matters related to digital crimes and privacy issues, and litigated class actions matters involving claims for invasion of privacy and defective products.

David’s work on matters related to digital crimes and privacy has included strategies to pursue Computer Fraud and Abuse Act (CFAA) claims and related injunctions, and surveys of various circuit and district court opinions regarding the application of ISP safe harbor provisions under the Digital Millennium Copyright Act (DMCA).

David’s class action work includes researching and drafting a recent successful motion to dismiss federal and state wiretap and privacy statutes (Electronic Communications Privacy Act, or ECPA,  and California’s Invasion of Privacy Act, or CIPA) and California unfair competition law claims brought against a rideshare company.

David is a graduate of the National Outdoor Leadership School, a leadership and education program focused on outdoor skills and environmental ethics. David also has a degree in environmental studies from the University of Oregon.
