Marisa is an experienced litigator whose practice at Shook is focused on domestic and international product liability and regulatory matters. She has a wide range of experience handling business and commercial matters, particularly those involving insurance and third-party claims. 

Marisa has represented clients in manufacturing, tobacco, distribution and retail, as well as food and beverage, agribusiness and automotive sectors. She also has handled matters involving public utilities, infrastructure, design and construction, as well as damage claims related to both residential and business properties. 

She also has completed secondments where she handled third-party medical liability and malpractice claims, as well as international casualty matters.

In addition, she has represented clients in cases involving professional liability and malpractice claims. She also has managed discovery matters (including eDiscovery), helped develop expert witnesses, and provided assistance in matters requiring Spanish-language communications. 


Representative Matters

Assisted in the defence of a multimillion-dollar claim on behalf of a consortium of insurers in a Bermuda Form arbitration arising from hundreds of underlying claims alleging property damage and personal injury from chemicals added to products distributed in the United States.

Defended a fatality claim pleaded at 720,000 pounds (approximately US $900,000) under the Consumer Protection Act 1987 and in negligence related to a telescopic ladder alleged to have been defective. 

Defended a UK oil tank manufacturer against a Consumer Protection Act 1987 claim for 45,000 pounds (approximately US $56,000) relating to a leak. 

Assisted in the defence of a UK-wide restaurant chain against claims related to alleged food poisoning.

Defended seven litigated linked negligence claims alleging vibration damage to property totaling 150,000 pounds (approximately US $190,000).

Defended a UK water and wastewater company and its insurers against high-value claims related to alleged escapes of water that resulted in damage to residential properties and businesses, including a FTSE 100 property developer and a precision engineering government contractor. 

Assisted on a subrogated recovery of 330,000 pounds (approximately US $400,000) on behalf of a construction company's insurers for damage allegedly caused by water infrastructure works; drafted standstill agreement, mediation position statement and settlement agreement.

Provided language, translation and communications assistance in a matter involving a major Spanish insurer with a claim in excess of 3 million pounds (approximately US $3.75 million). 

Handled settlement of a claim in contract against a building contractor and successful recovery of 75,000 pounds (approximately US $93,000) from third-party plumbing contractors. 

Assisted on a multimillion-dollar Bermuda Form Arbitration claim brought on behalf of an excess insurer client against a primary layer insurer in relation to an alleged failure to act in good faith.

Assisted on a claim brought by insurance syndicates against their coverholder in respect of an alleged breach of a Binding Authority agreement.
