Shook, Hardy & Bacon currently coordinates the defense of Philip Morris USA in certain smoking-and-health cases in Florida known as the Engle-Progeny litigation. Shook’s client is defending claims filed by more than 4,000 plaintiffs after the state supreme court decertified a statewide class action that was tried to a verdict with punitive damages awarded to the class. The decertification ruling permitted former class members to file individual lawsuits and rely on certain smoking-and-health-related findings returned by the jury during the class-action trial. Despite these findings, Shook has achieved considerable success.
