Shook was lead counsel for Akzo Nobel Inc. and its subsidiaries in a group of antitrust class actions alleging that a subsidiary of Akzo Nobel and its competitors had engaged in price-fixing for certain additives used in the manufacture of PVC plastics. Shook handled the approximately 15 direct and indirect purchaser antitrust class actions pending in federal MDL proceedings and state court, which were later centralized in the Eastern District of Pennsylvania.
Before the conclusion of discovery and before the court certified a nationwide class of direct purchasers of these plastics additives, Shook negotiated a favorable settlement for Akzo Nobel with a settlement class of direct purchasers, which was later approved by the court. MDL No. 1684 - In re Plastics Additives Antitrust Litigation (E.D. Penn. 2004).
