Martucci and McAtee Summarize Developments in US Employment Law for International Comparative Legal Guide

Shook, Hardy & Bacon Employment Litigation and Policy Partners William Martucci and Carrie McAtee and former Associate Najmeh Mahmoudjafari have contributed to The International Comparative Legal Guide to: Employment & Labour Law 2016. In a general chapter on "Global Employment Standards & Corporate Social Responsibility," Martucci and Mahmoudjafari address the need for global clothing companies to adopt systematic policies to promote worker safety. In particular, the chapter details corporate social responsibility (CSR) guidelines such as those propounded by Harvard Professor John Ruggie in his United Nations Human Rights Council Report, which advocates three essential components to a successful CSR program: "(1) corporate policy commitment to respect human rights; (2) a human rights due diligence process to identify, prevent, mitigate and account for how a company addresses its impacts on human rights; and (3) a process to enable the remediation of any adverse human rights impacts the company may have caused or to which it contributed."

In addition, Martucci and McAtee provide an overview of the latest developments in U.S. employment law by jurisdiction. Among other issues, the USA chapter discusses (i) terms and conditions of employment; (ii) employee representation and industrial relations; (iii) discrimination; (iv) maternity and family leave rights; (v) business sales; (vi) termination of employment; (vii) protecting business interests following termination; (viii) data protection and employee privacy; and (ix) court practice and procedure.
