Schleppenbach: Trump DOJ Focused on Health Care Fraud Enforcement

A series of criminal prosecutions announced by the U.S. Department of Justice (DOJ) in President Donald Trump’s second term has firmly emphasized that health care fraud is one of his administration’s top white collar enforcement priorities. Shook Partner Jay Schleppenbach discusses noteworthy prosecutions so far and what businesses can take away from them in an article titled “Recent Prosecutions, Announcements Show Trump DOJ's Focus On Curbing Health Care Fraud” in the October 2025 issue of Health Care Lawyer, a newsletter of the Illinois State Bar Association’s Section on Health Care Law. 

In the article, Schleppenbach points to DOJ’s June 30 announcement that it was prosecuting 324 defendants, including 96 doctors, nurse practitioners, pharmacists and other licensed professionals for their alleged participation in various health care fraud schemes. He says that DOJ’s actions are in line with the administration’s rhetoric—not only has the agency identified health care fraud as a top white collar enforcement priority, DOJ has also announced the formation of a False Claims Act Working Group. 

“With all signs pointing to increased enforcement of the laws prohibiting health care fraud, now is the time for health care companies to make sure their compliance programs are in top form,” he advises.
