Martucci to Discuss Statistical Sampling in California at ACI Wage & Hour Class Action Program in Los Angeles
Shook Partner Bill Martucci will speak at the American Conference Institute's 22nd National Forum on Wage & Hour Claims and Class Actions slated for September 29-30, 2014, in Los Angeles, California. Martucci will serve on a panel titled "The Use of Statistical Sampling When Defending Against Wage and Hour Class Actions in California," which will address (i) "[the] degree to which you can use statistical sampling as proof for certification of class claims"; (ii) "[the] use of statistical experts in class and collective wage-and-hour litigation in the state of California"; (iii) "[the] use of statistical samples to establish classwide liability"; (iv) "[the] use of representative testimony and statistical evidence in claims involving improper classification, denial of overtime, and meal and rest break infractions in violation of the California Labor Code"; and (v) "statistical methods to analyze class homogeneity, the importance of defining populations correctly, and when is sampling appropriate."
