Silverman Testifies Before Congress on Lawsuit Abuse
Shook, Hardy & Bacon Washington D.C. Partner Cary Silverman testified in support of the Lawsuit Abuse Reduction Act (LARA) at a hearing on March 17.
Invited by the House Judiciary Committee, Silverman testified on behalf of the U.S. Chamber Institute for Legal Reform before the Subcommittee on the Constitution and Civil Justice.
Silverman discussed how the Act would strengthen Rule 11 of the Federal Rules of Civil Procedure, the federal rule governing sanctions against frivolous claims and defenses. He included examples of the changes the Act could make including eliminating the 21-day “safe harbor” that allows lawyers to withdraw frivolous pleadings without sanction and making sanctions mandatory when a judge finds improper conduct.
