Shook Partner Quoted on Employment Law and Vaccine Mandates

With the public outcry over the termination of a popular local television anchor for her refusal to get a COVID-19 vaccine, the West Virginia Record interviewed Shook Partner Bill Martucci for “Legal Expert: Employers Have Right to Require Vaccinations and Can Fire Unvaxxed Workers.” 

Martucci, leader of Shook’s National Employment Litigation and Policy Practice, states that while there are some legal uncertainties regarding employer mandatory vaccine policies, so far decisions seem to be on the side of employers.  

“Case law favors the discretion of the employer to have a mandatory vaccination policy and enforcing it, even up to termination,” Martucci said.

Martucci practices nationally in business and employment litigation, with a considerable amount of his work focused on COVID-19 law since the pandemic began.
