Schwartz Joins Panel to Discuss Future of ALI at National Press Club
Partner and Co-Chair of Shook’s Public Policy Group Victor Schwartz will join the panel, “American Law Institute: Unbiased Analyzer or Agenda Driver?” at the National Press Club, June 5, 2019, in Washington, D.C.
The panel will discuss concerns in the legal community that the American Law Institute (ALI) is creating Restatements that are aspirational in nature that run counter to its mission: to distill and restate the opinions of a majority of state courts on difficult questions of common law. Some claim that ALI is simply interpreting the law, but some states are considering legislation that would prevent judges from referring to Restatements when deciding cases.
Scheduled panelists include John Fund, national affairs columnist for the National Review, the Hon. Seth P. Waxman and Edward Whelan, president of the Ethics and Public Policy Center. The moderator is the Hon. Susan G. Braden, former Judge of the U.S. Court of Federal Claims.
