Mealey’s Reports on Private RCRA Civil Cause of Action Verdict

Shook Partner Jad Davis spoke to Mealey’s about a first of its kind verdict,“ California Federal Jury Says Gas Station Owner Violated RCRA and CERCLA.”

Davis represented an apartment complex owner who sued under the Resource Conservation and Recovery Act (RCRA) for toxic leaks from nearby underground gasoline tanks. This is the first verdict where a jury has found an imminent and substantial endangerment under a private RCRA civil cause of action.
