Aubrey Kramer

Aubrey represents businesses and healthcare organizations in complex privacy and data security litigation, focusing on class action defense, major data breach matters and cutting-edge technology disputes involving novel theories of liability related to data collection, storage and use. She defends clients facing complex privacy claims arising from the use of pixels and similar website-tracking technologies, data breach incidents and evolving regulatory frameworks. She handles matters at multiple stages of litigation, from pretrial strategy through discovery and dispositive motions, combining practical judgment with innovative problem solving in high-stakes and rapidly evolving areas of the law.

Aubrey defends organizations navigating complex and uncertain privacy legal landscapes with clarity and creativity, particularly where regulatory frameworks and case law continue to develop. She works closely with clients to develop proactive, creative and innovative legal strategies in the face of cutting-edge privacy and cybersecurity issues, addressing both pending litigation and mitigating future risks.

Aubrey has developing experience interpreting and litigating privacy statutes including, the Electronic Communications Privacy Act (ECPA), the California Invasion of Privacy Act (CIPA), the Automated License Plate Reader (ALPR) and state data protection laws. She is skilled in responding to complex discovery, drafting written discovery requests, identifying trends in emerging privacy litigation and analyzing novel legal theories to position clients for successful defense.

Aubrey brings the perspective of a federal court litigator to every matter. During law school, she served as a legal intern to the Honorable Julie A. Robinson of the U.S. District Court for the District of Kansas, where she conducted legal research and drafted sophisticated memoranda for civil litigation. Drawing from this experience, Aubrey counsels clients on litigation strategies and legal analysis designed to succeed from pretrial positioning through resolution.

A graduate of the University of Kansas School of Law, Aubrey earned her J.D. with membership in the Order of the Coif. She served as articles editor and staff editor for the Kansas Journal of Law & Public Policy and participated in the law school's Mediation Clinic and Tribal Judicial Support Clinic, developing the writing, analytical and problem-solving skills essential to privacy litigation.
