Mallow, Nassihi, Straus and Wray: Trends and Developments in Product Liability & Safety

Shook Class Action & Appellate Litigation Practice Group Co-Chairs Michael Mallow and Amir Nassihi, along with Partners Rachel Straus and Christopher Wray, have co-authored a Trends and Developments article for the USA Section of Chambers and Partners’ Product Liability and Safety 2025 practice guide.

The article discusses the current state of Article III standing in class actions. They note that the U.S. Supreme Court in June left a critical question unanswered in the case of Laboratory Corporation of America Holdings v. Davis: whether every absent class member is required to demonstrate standing before class certification or only after to recover damages. Mallow, Nassihi, Straus and Wray say the debate over Article III standing in class actions remains far from settled.
