Mallow, Nassihi and Straus: Trends and Developments in Product Liability & Safety
Shook Class Action & Appellate Litigation Practice Group Co-Chairs Michael Mallow and Amir Nassihi, along with Partner Rachel Straus, have co-authored a Trends and Developments article for the USA Section of Chambers and Partners’ Product Liability and Safety 2023 practice guide.
The article discusses a series of Ninth Circuit cases addressing equitable claims. Mallow, Nassihi and Straus note that these decisions have led to bit of a quagmire: some district courts faced with a motion to dismiss equitable claims are splitting equitable claims from legal claims, causing problems for defendants. They also provide guidance for defendants looking to head off the quagmire resulting from these cases.
