Highlights from this issue include: 

  • Class Action Fairness Act (CAFA) Home-State Exception. The Seventh Circuit held the party relying on the home-state exception to CAFA jurisdiction has the burden of showing it applies and parties have a “reasonable” time to seek remand of actions that come within the home-state exception.
     
  • Class Action Settlements. The Seventh Circuit vacated a nationwide class action settlement approval because the settlement treated the claims of class members of certain states better than the claims of class members of other states, but none of the named plaintiffs were from the “disfavored” states.
