Cerner Prevails in Texas Patent Infringement Trial

Shook, Hardy and Bacon obtained a complete defense verdict for client Cerner Corporation in a two-week jury trial concluding Friday, Jan. 16. The trial took place in the U.S. District Court, Southern District of Texas, with Judge Gregg Costa presiding. RLIS, Inc., sued Cerner, alleging that Cerner had willfully infringed two of its patents. The patents dealt with electronic medical records; Cerner’s Power Note solution was at issue.

RLIS sought $38.2 million in damages; the jury found that there was no patent infringement, and that RLIS’ asserted claims were invalid.

Shook Intellectual Property and Technology Litigation Practice Group Chair Trent Webb led Cerner’s successful trial team.
